In Life's current Bicentennial issue, radio checks in, at #86 on the hot "100 Events That Shaped America," 19 buttons behind Bell's telephone. Erroneously, Life lists Guglielmo Marcon's dots and dashes as the first wireless broadcast, a fable echoed by the World Almanac and Encyclopedia Britannica. It's a forgivable mumpsimus, since the evidence offered on the following pages has not, until now, appeared in any national publication.
•••• The birth of broadcasting is a bizarre soap opera saga, a lacrymal legend of mystery, machination, ephemeral enshrinement, decline, disillusionment and disaster. It's denouncement dissolves six miles north of Murray, Kentucky, in a two-room shanty constructed of pine and cornstalks, where radio's uncelebrated architect is discovered 48 hours after his death, his records scattered, his equipment destroyed, his brain partly eaten by rats. Even local radio fails to mention his demise. He is Nathan Bernard Stubblefield, the man history over-heard and then overlooked.

NBSPatent02AutoDraw108w.jpgWhen an inordinately eccentric young farmer suggested that he had invented a portable wireless telephone that could broadcast voice and music up over hight buildings and down through stone walls, most of Calloway County, Kentucky, chuckled. When he revealed his "crazy box, and odd assortment of batteries, rods, coils and kegs, they howled.
•••85 years after, their heirs are writing songs of love, christening radio stations, consecrating libraries and constructing memorial monuments in his infinite honor. The veneration is hardly widespread. 17,000 Murray, Kentucky, tobacco farmers may agree that Nathan B Stubblefield was the first man on earth to transmit and receive the human voice without wires. But most of our world is unacquainted with his improbable name and even his proponents are unaware of the precise date of his private discovery. Evidence points to a period between 1890 and 1892, at least seven years before Marconi sent the first wireless telegraph message across the English Channel.
••• Stubblefield's supporters maintain that telegraphy is far different from telephony; that they are, I fact, diverse discoveries. Wireless telephone is hip-to-shore radio, the walkie-talkie, the citizen band and portable radio, the mobile phone, the audio arm of television, rheostats, rectifying tubes, filaments, dials, microphones, AM and FM radio and every broadcasting booth on earth--not Marconi's Code signals.
•••Marconi's name is linked with Stubblefield's by Trumbull White in a book called The World's Progress, published in 1902. "Of very recent success are the experiments of Marconi with wireless telegraphy, an astounding and important advance over the ordinary system of telegraphy through wires. Now comes the announcement that an American inventor, unheralded and modest, has carried out successful experiments of telephoning and is able to transmit speech for great distances without wires . . the inventor is Nathan B. Stubblefield."

•••"Hello, Rainey," according to Dr. Rainey T. Wells, founder of Murray State College, was the world's first radio message. Testifying before an FCC commission in 1947, Rainey explained that he had personally heard Stubblefield demonstrate his wireless telephone as early as 1892.
•••"He had a shack about four feet square near his house from which he took an ordinary telephone receiver, but entirely without wires. Handing me these, he asked me to walk some distance away and listen. I had hardly reached my post, which happened to be an apple orchard, when I heard 'Hello, Rainey' come booming out of the receiver. I jumped a foot and said to myself, 'This fellow is fooling me. He as wires somewhere.' So I moved to the side some 20 feet but all the while he kept talking to me. I talked back and he answered me as plainly as you please. I asked him to patent the thing but he refused, saying he wanted to continue his research and perfect it."
•••Dr. William Mason, Stubblefield's family physician, described a day during that same year when Stubblefield "handed me a device in what appeared to be a keg with a handle on it. I started walking down the lane . . . from it I could distinctly hear his voice and a harmonica which he was broadcasting to me several years before Marconi made his announcement about wireless telegraphy."
•••••• Stubblefield was born in Murray, Kentucky, 1860 the son of Attorney and Mrs. William Jefferson Stubblefield (Capt. Billy). In his teens he was reportedly an omnivorous student and researched everything available on the new science of electricity. When Alexander Bel phoned Tom Watson on March 10, 1876, to say "Come here, Watson; I want you," Stubblefield was already experimenting with vibrating communication devices. In 1888 (Patent #378,183) he invented a vibrating telephone. The Murray News Weekly carried this item: "Charlie Hamlin has his telephone I fine working order from his store to his home. It is the Nathan Stubblefield patent and is the best I have ever talked through."
•••Stubblefield manufactured and patented batteries which he later described as "the bedrock of all my scientific research in raidio" (his spelling).
•••••• "I have been working on this, the wireless telephone, for 10 or 12 years," he told a St. Louis Post-Dispatch correspondent in January, 1902. "This solution is not the result of an inspiration or the work of a minute. It is the climax of years. The system can be developed until messages by voice can be sent and heard all over the country, even to Europe. The world is it limits."

•••With the new industrial and scientific epoch at hand and the first Roosevelt in the White House, Stubblefield built his broadcasting station, a tiny workshop on the front porch of his modest farmhouse. It was barely wide enough to hold the transmitter and one char. The transmitting mechanism was concealed in a box four feet hight,tow and a half feet wide, one and a half feet deep. "In that box," said Stubblefield, "lies the secret of my success." Five hundred yards away was the experimental receiving station, a dry-good box fastened to the foot of a tree stump.
•••The St. Louis Post-Dispatch reporter noted that Stubblefield's 14-year-old son, Bernard, was left on the porch wile h and the inventor walked to the stump. The writer picked up a receiver and heard spasmodic buzzings and then: "Hello. Can you hear me? Now I will count ten. One-to-three-four-=five-six-seven-eight-nine-ten. Did you hear that? Now I will whisper." Later Bernard whistled and played the mouth organ.
•••"I heard as clearly as if the speaker were only across a 12-foot room" wrote the newsman.
•••When the article appeared on January 10, 1902, Stubblefield was besieged by capitalists, financiers, stock-jugglers, hucksters and hawkers. Dr. Mason recalled seeing a $40,000 check for a part interest in the invention, as titans of industry "wearing diamonds as large as your thumb" scuttled up industry dirt roads to Stubblefield's flinty farm.
•••"You and I will yet add luster to the Stubblefield name," wrote Nathan to his cousin, Vernon.
•••He refused all propositions, including one for half a million dollars. "It is north twice that," he insisted, entrusting only his son, Bernard, with the secret of his mysterious keg. On occasion he repelled over-inquisitive visitors with a shotgun.
•••Invited by leading scientist, he traveled with his trunk of mystery to Washington, D.C., where he demonstrated the practicability of his contrivance from the steamship Bartholdy on the Potomac to crowds along the river bank. On Decoration Day, 1902, he broadcast words and music form the Belmont Mansion and Fairmont Park in Philadelphia to hundreds of statesmen, investors and newsmen. He obtained patents in England, the U.S. and Canada.
•••• In the Canadian patent is a drawing of a "horseless carriage" with a broadcasting set, presaging the auto radio by 30 years. But perhaps even more remarkable are notations that by reversing a switch one could change a broadcasting station into a receiving apparatus.
•••• Articles appeared in major newspapers throughout the world acclaiming him as the distinguished inventor of the wireless telephone and a celebrated scientific genius. At lease one extravagant reporter suggested that Stubblefield ad crated "the world's greatest invention."

•••• There are three conflicting theories on how this farmer-inventor sowed the wind of immortality and reaped the whirlwind of oblivion. His cousin, Vernon, claimed the invention was stolen

"Will I ever see my trunk again?" Stubblefield scribbled on the back of an old map after he returned from Washington.
•••• "All his valuables were in that trunk," said his cousin.
•••• Perry Meloan, newspaper editor of Edmonton, Kentucky, an ear-witness to the first public demonstration in Murray, declared that Stubblefield was inveigled into a partnership in the Wireless Telephone Company of America, located at Broadway 11, New York. Learning that the firm was not interested in perfecting his creation but merely in selling stock unscrupulously, Stubblefield returned home. "Damn rascals," was his bitter comment to friends, and he advised them to withdraw their investment in his project. Soon after, he renounced his wife, nine (5 surviving) children and all relatives and built his hermitage gut in Almo, six miles from his family farmhouse. That farmhouse later mysteriously burned to the ground.
•••• His son, Bernard, joined the Westinghouse Electrical Corp., the firm that introduced the commercial radio. Did Bernard utilize his father's secrets to produce those early sets?
•••• Wireless lights appeared in the trees and along the fences guarding Stubblefield's crudely constructed shanty and, according to neighbors, voices, apparently coming from the air, were heard by trespassers. "Get your mule out of my cornfield," Stubblefield's wireless voice was hard to say in the night.
•••• He curtly refused the aid of friends. "He was never insane," they insisted, "only queer."
•••• Robert McDermott found the body of Nathan Stubblefield on March 30, 1928. "Death due to starvation," was Dr. Mason's conclusion. In a unmarked grave in Bowman's cemetery, one and a half miles form Murray, Stubblefield lies alone.
HarveyGellerPeo108w.jpg•••• In 1930 a memorial to "the first man to transmit and receive the human voice without wires" was dedicated at Murray State Teachers College campus, less than 100 feet from the charred ruins of the world's first broadcasting station.
•••• In 1962 his tragic life was dramatized in an epicedial folk opera, The Stubblefield Story, composed by Murray State professor Paul Shahan and Mrs. Lillian Lowry and performed in the campus auditorium.
•••• Murray's only radio station, 1 1000-watt outlet, broadcasts "middle of the road and some rock music as well," according to owner Fransuelle Cole. Book-ended between Bruce Springsteen's "Borne to Rune" a a live commercial for Kroger's grocery, on hears. "You are tune to WNBS, 1340 on your radio dial in Murray, Kentucky: the birthplace of radio."
•••• The stations call-letters, not accidentally, are Stubblefield's initials.

•••• While Disneyland is refurbishing some old favorites for the event, the stars of the Diamond Celebration will be its new nighttime shows, including the "Paint the Night" parade featuring 1.5 Million LED Lights and Characters from: Poplular Disney Movies, like Monsters Inc.; Cars; The Little Mermaid; Beauty and The Beast; Toy Story; Frozen; ••••

Visitors to Hong Kong Disneyland have seen this parade already, as "Paint the Night" debuted there last fall.
•••• The Park will debut a new Fireworks show during the 24 hours bash. and The castle's ready for the event, which kicks off with a 24-hour party on May 22.
••••The newly refurbished Matterhorn Bobsleds, with its enhanced Yeti animatronic, will reopen on the big day, May 22.
•••• Fans won't have to wait until the 22nd to get their first present. Over at the Haunted Mansion, the new version of the Hatbox Ghost materializes on May 9. Riders have been keeping their eyes on this new window outside the attic scene, which is expected to be the new home for the Hatbox Ghost.
••••But fans will have to wait until July 1 for the return of Peter Pan's Flight, which also will feature newly enhanced effects.
•••• The third new show for the 60th will play over at Disney California Adventure, which will debut a new version of "World of Color," honoring Disney's history and narrated by Neil Patrick Harris.
••••If you can't wait for these tributes, you can get a helping of Disney nostalgia at the Tomorrowland movie preview, playing at the Magic Eye Theater through the end of the month.

106- Net Neutrality rules formally published; first legal challenge filed
WASHINGTON -- Tough new net neutrality regulations were published in the Federal Register on April 13, 2015, that started a 60-day clock on its effective date of June 12 and triggering the first formal legal challenge to the controversial online traffic rules.
•••• US Telecom, a trade group whose members include AT&T Inc. and Verizon Communications Inc., filed a lawsuit in the U.S. Court of Appeals for the District of Columbia Circuit to stop the rules, arguing the rules are "arbitrary and capricious" and violate federal law.
•••• The Federal Communications Commission approved the regulations by a 3-2 vote on Feb. 26.
They hanged the legal classification of wired and wireless broadband, treating it as a more highly regulated telecommunications service in an attempt to ensure that providers don't discriminate against any legal content flowing through their networks to consumers.
••••But FCC Chairman Tom Wheeler who pushed for the regulations, has said, "we are confident the FCC's new open Internet rules will be upheld by the courts, ensuring enforceable protections for consumers and innovators online."
••••The group's members support the goals of the regulations, to ensure the free flow of legal online content, US Telecom President Walter McCormick said. The suit was filed because the more stringent government oversight that comes with broadband's new regulatory classification will hinder investment in expanded networks and increase costs for users, he said.

"My life has been a great ride with more than it's share of high points; even the lower points taught me and led me to higher ones.  In my teen years I thought I was born to act, but when my acting career was interrupted, I discovered a wonderful world of challenges, which became opportunities, opening up my life far beyond acting.  I am very grateful for all the good fortune I have been given in my blessed life.  Receiving this award reminds me of the best idea I've ever had, that of 'Thankful Giving,' on Thanksgiving Day by showing gratitude for what we have by passing a bowl around the table to take up a collection to share the monies with a charity of choice to ease hunger throughout the world for those who have far less than we do.  My concept of a new Thanksgiving observance called, 'Thankful Giving' was passed by both houses of Congress in 1978 and President Jimmy Carter advocated it in his proclamation."
••••   As Ken Howard introduced Marsha Hunt, the first recipient of the "Hunt For Humanity Award," he said: "I've had the opportunity to honor some very accomplished people over the years and it has been a moving and thrilling experience to do so, but tonight…tonight is special because of the recipient.  She is a giant among giants and a grand dame of cinema and entertainment.  She is described as kind, generous, thoughtful, brave and deeply concerned with the plight of her fellow humans.
••••    "Marsha started her career as a John Powers model in New York, but it wasn't long before she was in Hollywood and in the movies.  Her roles were many and varied and include more than 50 films for two major studios throughout the thirties and forties.  Her most notable accomplishments span the industry beginning in 1945, when she served on the board of directors of Screen Actors Guild for over two years and was an elected union leader protecting her fellow members during the presidencies of George Murphy, Robert Montgomery and Ronald Reagan.  She was a committed unionist and an engaged activist.  She was a staunch supporter of freedom of speech and could be counted on to fight for the First Amendment and for her friends and colleagues.
••••   "In 1947, Marsha flew East with a delegation of actors in support of the 'Hollywood Ten' who were appearing before the House on Un-American Activities.  The delegation of the 'Committee for the First Amendment,' as they called themselves included former S.A.G. board members Humphrey Bogart and Lauren Bacall, Danny Kaye, Sterling Hayden, Paul Henried, Jane Wyatt, Richard Conte, Geraldine Brooks, Sheppard Strudwick, June Havoc and others.  It was an act of bravery for which some members, including Marsha, would later pay a high price.
••••   "One year later, Marsha graced the cover of LIFE magazine's March 6 issue and just two short months after that, her name would appear on page 85 of Red Channels:  The Report on Communist Influence in Radio and Television.  Through that publication, her name was connected to seven activities and organizations deemed 'subversive' or 'Communist fronts.' Her open support for the 'Hollywood Ten' and her continued protests against their treatment resulted in the general 'gray-listing' of Marsha that would continue for decades.
••••    "Not one to stand still, Marsha became active in the San Fernando Valley chapter of the American Association for the United Nations, becoming its president in 1961.  In 1962, she was lucky to escape a terrorist bomb attack on the home of two minister-colleagues.  Fortunately, as was reported at the time, Marsha was spared when the terrorists were unable to find out where she lived.  She continued to work for the U.N. as a volunteer for many years and received an award for her service.
••••    "Although she was never called before the House on Un-American Activities Commission, the damage was effectively done and she would only rarely find film work throughout the next several decades.  By the sixties, she was semi-retired from the industry but still devoted to UNICEF, the United Nations, and various charitable organizations still working for humanity and fighting for justice.

••••  Actor Martin Sheen introduced the Keynote Speaker of the evening, Tim Edwards, Executive Trustee of Bhopal Medical Appeal by saying, "Arriving in the city of Bhopal in 1999 following a solo cycle ride from the United Kingdom, Tim found that the privilege of a first-world upbringing gave him the skills needed to advocate for the people he met in Bhopal -- people who possessed strength, humor, intelligence and resilience in abundance, but whose life circumstances had conspired to deny them a voice in the world.  Tim has advocated on behalf of Bhopal, advising on the social, legal, environmental and medical complexities of Union Carbide's disaster, ever since.  He was a founding trustee of the Bhopal Medical Appeal, and has been its managing trustee for the last four years.  Over this time, the two clinics supported by the Appeal in Bhopal, Sambhayna and Chingari, have helped relieve the suffering of thousands of gas and toxic water-affected men, women and children.  They are the only places in Bhopal where victims of Union Carbide's gas and water poisoning can receive medical care free of cost."

••••     Tim Edwards, Executive Trustee of Bhopal Medical Appeal delivered the Keynote Speech, reflecting on the current status of survivors of the Bhopal tragedy over 30 years ago and what his organization is doing to help survivors of the tragedy.
•••  Edwards said, "We'll shortly be watching the most realistic recreation of Union Carbide Corporation's Bhopal gas disaster ever filmed.  Ravi (Kumar) approached me with his script nine years ago, and I must admit I had severe doubts it could ever succeed.  First, the script depicts events for which civil and criminal liability are still being contested in several courts. How would it be possible to make an engaging and truthful drama whilst avoiding offense to the victims or the accused?
••••    "Second, the Bhopal disaster was of a scale that defies ordinary comprehension, never mind visual framing.  Thirty tons of poisonous gas spread over five square miles of a densely populated city.  Eight to ten thousand people &endash; or possibly more, there are no precise figures &endash; dead within three days.  Over 570,000 surviving men, women and children damaged permanently by a cocktail of gases so toxic it stripped the lining from their lungs, ravaged their organs and scrambled their chromosomes.

• • • Based on copyright infringement, a federal jury in Los Angeles found that the 2013 hit song "Blurred Lines" infringed on the effects, elements and components of the Marvin Gaye chart-topper "Got to Give It Up," the soul singer's 1977 hit, awarding nearly $7.4 million to Gaye's children. It was 2013's biggest hit. The song brought in $5.6 million for Thicke, $5.2 million for Williams, about $700,000 went to T.I and another $5 million to $6 million or more for the record companies, (Interscope, UMG Distribution and Star Trak) as well as an additional $8 million in publishing revenue. Overall, the Gaye family sought more than $25 million in damages. Jurors found against singer-songwriters Pharrell Williams and Robin Thicke, but held harmless the record company and rapper T.I.
• • • Gregory Butler, Los Angeles based composer and producer said colleagues in the industry were stunned by the verdict. "You've made it illegal to reference previous material," said Butler, also a managing director at music startup WholeWorldBand. "I'm never going to come up with something so radically different that it doesn't contain references to something else."
• • •Joe Escalante, an entertainment law attorney, said he was concerned that the jury's decision had been driven by emotion rather than what's protected under copyright law.
• • • On the other hand, a veteran music industry executive said that protecting creative work was just as important to musicians, and that inspiration bordering on copying was becoming too common.
• • • "Somebody should be protecting that," said the executive, who asked not to be named because he might work with those involved in the case in the future. "If it has a chilling effect on copyright infringement, that should happen.... Stopping theft is what we're talking about."
• • • The Gayes contended that they instantly recognized striking similarities between the two songs when they first heard "Blurred Lines." They called to the stand a musicologist who analyzed the songs and concluded there was a "constellation" of eight similar elements. Others outside court had also noticed similarities.
• • • According to Mark Anderson, of PSI, the infringement is an analogy to the copycat telecom carriers using Nathan B. Stubblefield's 1902 telekey number systems.
• Copied elements-
• • • An attorney for the Gaye children, Richard Busch, said there were copied elements -- including the bass and keyboard line, the hook and a repeated theme -- in all but two bars of "Blurred Lines."
• • •Williams alone wrote the song with no input from Thicke, and that neither Gaye nor his song was discussed in the song's creation.
• • •Thicke, during his turn on the stand, played a medley of pop songs on a keyboard to demonstrate that many of them share the same chord progression and can sound similar.
• • • According to Mark Anderson, of PSI the infringement is an analogy to the copycat elecom carriers using Nathan b. Stubllefieldes telekey phone number systems.
The verdict is notable-
because Gaye's 1977 hit was published just before a major overhaul of copyright law in 1978, so the jury had to fall back on 1909 copyright law to determine whether Thicke and Pharrell had infringed.
• • •In an early pretrial hearing, the judge ruled that the 1909 law only protected the song's sheet music, not the actual sound of the song.
• • But in a later hearing, the judge changed his mind, ordering Thicke and Williams' lawyers to produce an audio version of the specific elements of the song that were copyrighted and on file at the Library of Congress.
• • • That version included a bass line and some keyboard chords under Gaye's voice, but not the similar percussion that tends to draw people to make the connection between the two songs. The jury heard "Blurred Lines" repeatedly throughout the trial but never heard the full version of "Got To Give It Up."
• • •Williams, 41, also signed a document stating he didn't use any other artists' work in the music and would be responsible if a successful copyright claim was raised.
• • • Jurors repeatedly heard the upbeat song Blurred Lines and saw snippets of its music video, but Gaye's music was represented during the trial in a less polished form. Jurors did not hear Got to Give It Up as Gaye recorded it, but rather a version created based solely on sheet music submitted to gain copyright protection.
• • • That version lacked many of the elements --; including Gaye's voice --; that helped make the song a hit in 1977.
• ••An expert for the Gaye family said there were eight distinct elements from Got to Give It Up that were used in Blurred Lines.
• • •The verdict could have implications for songwriters everywhere and may also have implications beyond the massive verdict.
• • Still, while testifying last week, Williams said the two songs share "feel -- not infringement."
• •The attorney for the Gaye family, Richard Busch, will also seek to halt sales of "Blurred Lines," and said he will file official paperwork by next week.
• • •The verdict may face years of appeals.

106- Is the Digital Millennium Copyright Act a Safe Harbor? --
Court denies Grooveshark DMCA protection for songs like "Johnny B. Goode"
In April 2013, a New York state appellate court made a curious decision in a matter being litigated between Grooveshark parent company Escape Media Group, Inc. and UMG Recordings, Inc. The court ruled that due to an peculiarity in copyright law, the Digital Millennium Copyright Act does not apply to songs that were licensed under state law before February 15, 1972. As such, for these recordings, Grooveshark is not eligible for what is known as safe harbor -- an immunity to liability if users upload copyrighted works without the website's knowledge.
•••• As a website that allows users to upload their recordings, Grooveshark's business model depends on the DMCA. Users upload songs on Grooveshark and are warned about uploading copyrighted material. If a rights holder discovers that a user has uploaded a copyrighted song, the rights holder notifies Grooveshark. As long as the website takes the song down quickly enough, Grooveshark avoids being held responsible for the infringement.
• 1972
But an anomaly in copyright law is throwing a wrench in that system. In 1971, Congress overhauled copyright laws, making most protection a federal matter. However, recordings copyrighted before February 15, 1972 would remain under the purview of the common law and statues of the individual states. The new federal copyright prescriptions noted that "any rights or remedies under the common law or statutes of any State shall not be annulled or limited by this Title until 2067."
•••• With this in mind, UMG brought litigation against Grooveshark saying that the DMCA, a federal act, does not apply to these recordings under common law. So the website is still liable for copyright infringement if a user uploads, say, Chuck Berry's "Johnny B. Goode" (written in 1958) without Grooveshark's knowledge.
•••• A 2010 filing by UMG in the case says that these titles under state copyright protection include works from "Buddy Holly, The Carpenters, Cat Stevens, Chuck Berry, The Jackson Five, The Mamas and the Papas, Marvin Gaye, The Supremes, The Temptations, and The Who."
•••• While a New York District court initially ruled in Escape Media and Grooveshark's favor, the New York appellate court took a very different view. "Initially, it is clear to us that the DMCA, if interpreted in the manner favored by defendant, would directly violate section 301(c) of the Copyright Act," the court's decision read.
About the DMCA
•••• The Digital Millennium Copyright Act (DMCA) is a United States copyright law that implements two 1996 treaties of the World Intellectual Property Organization (WIPO). It criminalizes production and dissemination of technology, devices, or services intended to circumvent measures (commonly known as digital rights management or DRM) that control access to copyrighted works. It also criminalizes the act of circumventing an access control, whether or not there is actual infringement of copyright itself. In addition, the DMCA heightens the penalties for copyright infringement on the Internet.
•••• Passed on October 12, 1998, by a unanimous vote in the United States Senate and signed into law by President Bill Clinton on October 28, 1998, the DMCA amended Title 17 of the United States Code to extend the reach of copyright, while limiting the liability of the providers of online services for copyright infringement by their users.

••March 10, 2015- It's been two weeks since the Federal Communications Commission voted 3-2 to overhaul the way broadband Internet service is regulated, changing it from a Title I information service to a Title II telecommunications service - by expanding the definition of conventional phone service to include Internet address as well as phone numbers, according to the order.
••••And only now is the 400-page order, not released prior to the vote, that was drawn up by FCC Chairman Tom Wheeler and supported by the commission's two Democratic members, available for public viewing. This was perhaps the most significant and far-reaching shift in Internet policy in nearly two decades, and put in place without full public access.
The FCC's catchall, 'just and reasonable' provision.'
••••And yet even though the rules are now available for all to see, it still remains somewhat unclear how exactly they will work in practice. As noted by the New York Times, the FCC is "set to decide what is acceptable on a case-by-case basis. The regulations include a subjective catchall provision, requiring 'just and reasonable' conduct."
••••What counts as 'just and reasonable' will, naturally, be up to the whims of the FCC.
••••In some ways, this is the worst part of the agency's net neutrality push. It's not even that it puts in place bad rules; it's that it installs potentially strict but ultimately vague rules, and leaves the FCC as the final arbiter of what is and isn't acceptable. The FCC will have some guidelines, of course, but Wheeler's book-length bureaucratic proposal will surely provide legal ammunition for whatever creative interpretation the agency settles on - or desires - at any given time.
New net neutrality rules give the agency veto power over ISP innovation
••This is give or take what to expect in the wake of the FCC's rules; ISPs will probably invest and innovate more cautiously, knowing that the FCC has veto power over their decisions. And armies of expensive telecom lawyers will spend their days arguing about what, exactly, constitutes "just and reasonable" in a wide variety of situations.
••••As telecom analyst Roger Entner told the Times, "Telecom lawyers in Washington popped the corks on the champagne," when the rules were passed last February 26. "It will be at a least a hundred million in billable hours for them. This will go on for an unforseeble time."
••••Critics at times describe net neutrality as a government takeover of the Internet. This is in most ways an exaggeration; the Net will remain for the most part privately operated, with competing though heavily regulated firms continuing to own and operate the infrastructure.
•••• ISPs will now need the FCC's permission, at least tacitly, to innovate and to invest, and they will inevitably make major business decisions with the FCC's veto power in mind. The agency, and its nebulous "just and reasonable" standard, will be a shadow presence whenever any major move is contemplated. The publication of the FCC's order, in other words, mostly serves to confirm that the rules will mean whatever the agency wants them to mean.

114- TV Newsman, Stan Chambers died.

Back in 1949, when the Story broke that a little girl was trapped in a well in San Marino thousands of Angelenos snapped on their Television sets. They kept them on for the next 27 hours. Stan Chambers, one of the two reporters with Bill Welch on the scene for KTLA-TV Channel 5's unusual broadcast, recalled years later of this role in TV News History. "It was then that I decided that I really wanted to be in News."
•••• Stan Chambers was with KTLA 5 News for 63 Years and covered over 22,000 stories for the Los Angeles TV station from fires, floods,plane crashes, to car chases, and more. Among the major stories Chambers reported were the 1961 Bel-Air Fires/Brentwood Fire, the 1963, Baldwin Hills dam disaster, the 1965 Watts Riots, the 1968 assassination of Senator Robert F. Kennedy, the 1971 Sylmar Earthquake and the 1984 Olympics.
••••Before he retired in 2010, he received the longtime broadcaster for the Society of Professional Journalists' Helen Thomas Lifetime Achievement Award in 2006. His many honors include numerous local Emmy and Golden Mike award, a star on the Hollywood Walk of Fame and a building at KTLA named after him.
••• Chambers passed away on February 13th, 2015 in this home in Holmby Hills, California. He died at 10:30 am at 91 years old. He was a gentleman, and one of the nicest persons, always treating people with respect. I had known Stan Chambers for about 50 years.

••• Gary Owens whose deep voice was one of the most famous in show business, was a familiar part of radio, TV and movies for more than six decades.
•••• He hosted thousands of radio programs, appeared on scores of TV shows, including Lucille Ball and Bob Hope specials, did commercials and also voiced hundreds of animated characters.
••••On "Laugh-In," the 1968-73 sketch show starring Dan Rowan and Dick Martin, Owens was shown on camera in a parody of an old-school announcer, with his hand cupped firmly over his ear. But his voice was always the real thing, rich and authoritative.
••••Owens had "such a great voice, so smooth. That was his real voice, even if he was ordering in a restaurant," said Tom Kenny, the "SpongeBob SquarePants" voice actor who worked with Owens on cartoons including "Dexter's Laboratory."
••••"Laugh-In" creator and producer George Schlatter, who knew Owens but said he hired him for the show after hearing his voice boom through the Smoke House restaurant restroom, called him a "lovely, lovely man."
••••"He had a whimsical, fey sense of humor and he brought a lot to 'Laugh-In' in the way of thoughts, words and jokes," Schlatter said.
••••Given Owens' jam-packed resume, was he a workaholic?
••••"Gary did not work. Gary played," Schlatter said. "He was a very charming, creative, witty guy who had a good time."
•••• Owens, a native of Plankinton, South Dakota, was inducted into the National Radio Hall of Fame in Washington D.C. in 1995 and into the National Television Hall of Fame in 2001.
••• He arrived in Los Angeles in 1961, and was heard on a variety of Los Angeles radio stations including KMPC, KFI and KIIS FM, and hosted a national show on The Music of Your Life Network. He was part of Armed Forces Radio for 10 years and host of the syndicated "Soundtrack of the 60s."
"Beautiful downtown Burbank"-
the catchphrase coined by Owens on his KMPC show, became a favorite of Johnny Carson on NBC's "Tonight Show."
••••Owens' animation voiceover credits include "Space Ghost," ''Blue Falcon" and "Garfield and Friends" and "The Ren & Stimpy Show."
••••"National Lampoon's European Vacation," ''The Green Hornet" and "Neil Simon's Prisoner of Second Avenue" were among his film credits.
••••Besides son Scott, Owens is survived by his wife of 57 years, Arleta, and their son, Chris, a musician and producer.

•••The idea of a universal translator has been a longtime fixture in science fiction and a welcome tool of every language student.
•••• The app is an advanced mobile-translation tool, recognizing more than three dozen languages. But it's part of a much bigger trend and, with service like Microsoft's Skype translator, turning video chats into real-time multilingual conversations.
•••• With the new app, you are able to detect the languages being spoken so you don't even have to press the translation button on the phone each time you talk. It's now so much more natural.
Google Translate has had voice controls for a few years, but the latest version works more seamlessly.
••••In this version, the app is supposed to pick up who is talking based on the language being spoken. So, say you wanted to order a slice of chicken pizza in Italian. Using the app, you could walk into a pizza parlor, and, with your lips at an awkward proximity to the phone's microphone, make your request, after which a robotic voice would spit out the question in Italian.
•••••Google has been doing some form of translation since 2001. The Google Translate app now has 90 languages and some one billion daily users. Barak Turovsky, the product leader for Google Translate, said that 95 percent of the people who use Google's translation technology -- whether on a phone or desktop -- live outside the United States.

115- CES 2015: Wearables Everywhere. Intel demos button size wearable computer
•••• Intel CEO Brian Krzanich showed off a minuscule computer, dubbed Curie, during a keynote speech at the International Consumer Electronics Show in Las Vegas. He pulled a button off his blazer, and chatted with someone through a robot during the keynote presentation.
•••• The button stick let him unveil Curie, a new computing module that's the size of the button. It's tiny size emphasizes it can power a raft of new wearable technology such as rings and bracelets. Curie will become available to wearable makers this year.
•••• Curie appeared much smaller than a postage-stamp-size computer, called Edison, that Krzanich showed off at last year's CES, and is a sign that hardware makers are eager to build wearable devices of all kinds. It also points to the unwelcome size of many existing smart watches and smart glasses.

CES 2015: • 106- Net neutrality rules reclassification proposed
••• Federal Communications Commission Chairman Tom Wheeler strongly hinted Wednesday at the Consumer Electronics Show in Las Vegas that he would propose net neutrality rules next month that treat broadband Internet service providers as utilities subject to much stricter regulation. That however would clash with powerful cable tv operators that offer Internet access.
•••• If Wheeler does propose to reclassify ISPs and regulate them under Title II of the Communications Act, that would be a stinging defeat for ISPs and a victory for advocates of a stringent approach to net neutrality -- including President Obama, who appointed Wheeler. It also would almost certainly draw a challenge in court and from the Republican-controlled Congress.

•••• Known as the most favorite parade to kick off the New Year for thousands of spectators who lined the 5 1/2 mile parade route through Pasadena. With temperatures dipping into the 30s crowed braved the chill for the 126th Rose Parade, and embraced an occasional beam of sunshine as some were bundled up in blankets and scarfs in grandstand seats and choice spots on sidewalks along the route. The 2015 theme chowcased those who "elevate the human spirit by who they are, what they have done and what they continue to do.
•••• Every year I revel in the excitement, exuberance and optimism in the air, and again this year's themed "Inspiring Stories", didn't find me disappointed.
••• "Inspiring Stories" was the theme of the 126th Rose Parade presented by Honda.
•••• The very nature of this theme allows us to reflect on and appreciate many people around us who elevate the human spirit by who they are, what they have done, and what they continue to do. It pays tribute to those who have loved unconditionally, persevered courageously, endured patiently and accomplished much on behalf of others.

Casey Kasem, a radio voice who connected generations of Americans to thousands of rock and pop acts, died Father's Day, June 15, 2014. Kasem, hospitalized in Washington state since June 1, had been in declining health. The longtime host of radio's American Top 40, which he started in 1970, was a familiar voice to millions, known for his signature closig advice: "Keep our feet on the ground and keep reaching for the stars."
•••• Kasem founded the American Top 40 franchise with Don Bustany, Tom Rounds and Ron Jacobs and hosted it from 1970 to 1988 and from 1998 to 2004. Between January 1989 and early 1998, he was the host of Casey's Top 40, Casey's Hot 20, and Casey's Countdown. Also beginning in 1998, Kasem hosted two AC spin-offs of American Top 40, American Top 20 and Ameican Top 10. He retired from AT20 and AT10 on July 4, 2009 and both shows ended on that day. Ryan Seacrest took over the AT40 franchise in 2004.
•••••• Kasem supported a number of other progressive causes, including affordable housing and the rights of the homeless, animal rights and environmental causes, and was a critic of factory farming.m was a
•••• He was married to Linda Myers from 1972 to 1979 with whom he had three children, Mike, Julie, and Kerri Kasem.
From 1980 until his death, Kasem was married to actress Jean Thompson. They had one child, Liberty Jean Kasem.

Robin Williams, a comic and sitcom star in the 1970s who went on to became an Oscar-winning dramatic actor died at his home in Tiburon, Marine County.

•••• From the inception of the Internet until the late 1990s, the Internet was free of government regulation in the United States at all levels, and also free of any specially targeted tax levies. By 1996, however, that began to change, as several U.S. states and municipalities began to see Internet services as a potential source of tax revenue.

Justices accept argument of major broadcasters that Aereo's service amounts to a violation of copyright law.

••••The US supreme court has ruled that Aereo, the TV streaming service backed by media mogul Barry Diller, is illegal.
•••• In a 6-3 decision, the court rejected an earlier appeals court decision which had ruled the fledgling service did not breach broadcasters' copyright. The Supreme Court has ruled that Aereo, the upstart television streaming service, violated copyright laws by resending broadcast signals without paying licensing fees.

WASHINGTON DC &endash; After consideration and study of the GN Docket No. 12-268 REPORT & ORDER released by the Federal Communications Commission (FCC) on June 2nd, the Advanced Television Broadcasting Alliance (ATBA) voiced concern that the FCC has declared war on broadcasters, especially LPTV and Translator stations. The FCC is seemingly denying a significant amount of the nation free over-the-air television access in favor of providing well-funded wireless carriers with more spectrum for profit. The FCC in the R&O concluded that the concerns of broadcasters "are outweighed by the detrimental impact that protecting LPTV and TV translator stations would have on the repacking process and on the success of the incentive auction."

•••• Victor Harwood who is presiding over several annual trade shows dealing with entertainment, media, advertising and technology events, besides Digital Hollywood, said back in 2007, "The idea of putting together a tradeshow by hassling people to buy booth space is old -- anyone who did that is not in business anymore."
•••• His upcoming Spring confab at the Ritz Carlton Hotel, in Marina Del Rey, CA, made up of separate multi-track but co-located events is still the only conference that brings together creatives, agents, distributors, technologists, financiers, lawyers and media -- legally, it's very hard for a lot of these people to be in the same room, unless there's a common purpose and a common theme. More minds have been changed -- at Digital Hollywood than at any other conference."

The Areo Debate "To Be or Not to Be," provided food for a heated discussion at the Digital Hollywood Spring conference May 7, 2014. Moderated by James M. Burger, Partner, Thompson Coburn, Neil W. Netanel, Professor of Law, UCLA Law School; John C. Ulin Partner, Arnold and Porter midway through the debate were interreupted by questions of the audience which became increasingly agitated. It did make for a lively debate though considering the fact that most panelists usually take questions only at the end of a panel discussion.
•••• A ruling to be followed closely by advocates of net neutrality, and broadcasters, the US Supreme Court justices questioned the legality of Areo as they weighed whether the starup violates copyright law by recording over-the-air programming from an off-site antenna and delivering it to customers via the internet. Areo aims to upend the broadcast industry's decades-old business model by letting customers in 11 cities watch live and recorded shows for as little as $8 a month.
•••• Barry Diller, Chairman and Senior Executive of media company, IAC/InterActiveCorp, said broadcasters are seeking to stifle innovation for their own financial gain by suing to shut down Aereo Inc., the streaming-video company he's backing. "I am really tired of being accused of stealing anyone else's programming when we are not," Diller said. "It's kind of obnoxious to take away programming they have promised the public they could receive directly simply because they want to take away every dollar from consumers.

Aereo's faceoff at the nation's highest court against broadcasters including 21st Century Fox Inc., and CBS Corp, stemmed from its bid to forge a technological route around the television companies' copyrights. It was Diller, co-creator of Fox's broadcast network, who pushed Aereo beyond its original plan to offer services only in parts of New York, Aereo CEO Chet Kanojia stated.
•••The Supreme Court arguments didn't indicate a like outcome, as justices, including Stephen Breyer repeatedly questioned whether ruling against Aereo would broadly imperil cloud-computing technologies that let consumers remotely store content such as video and access it through the Web.
•••• U.S. copyright law gives owners the exclusive right to perform their works "publicly." If Areo is deemed to be a public rather than private performance, the ruling may affect cloud storage offerings from companies like Google Inc., Dropbox Inc., Apple, Amazon.com Inc. and Box Inc.

•••The Cable Show, the industry's 2014 annual gathering in Los Angeles had no shortage of news to pick apart given Comcast's 45 billion deal  to buy Time Warner Cable as well as the deal Comcast cut with Charter Communications.
•••• But what was actually on the minds of many were the companies that weren't at the show at all: Netflix, Hulu, Amazon.com, Google, Yahoo, AT&T, Verizon, Dish and DirecTV -- essentially every company that isn't strictly speaking a cable company.
•••• However, the fact that Netflix was nowhere to be found at the show, either at the session or on the exhibition floor, was telling.
•••••The National Cable and Telecommunications Association, which runs the Cable Show, says companies such as Netflix have appeared at the conference in the past to participate on panels, but they've never been a big presence.
•••• Many of the cable networks, such as Turner (which owns CNN and TNT), Fox News, Discovery Communications and AMC were there partly to show off their programming, but mostly to take meetings with the cable industry. Privately, some of them have said the conference would be more useful if the satellite and telephone companies were also here.
•••• If the Comcast merger is approved by regulators, Time Warner Cable won't exist next year, turning the Cable Show into the Comcast show.
