Troy Cory collaborated with Cinema Prize Records and Agil Musik and co-wrote the song material with the Seelos/Levay/Michalke/Sigl/ team, in producing the album, entitled, "Today's Puzzle."
The end of the 1970s found Troy Cory playing Santa Claus in the German/American production film "Merry Christmas: Just in the Nick of Time," starring Priscilla Cory, as "Little Miss Santa," and featuring the late German singer, Manuela. Produced by VRA TelePlay Pictures, Bohemia Film and Gábor Wagner, of ARD, the story was filmed in and around the city of Munich, Nymphenburg and Castle Neuschwanstein, Germany and in Oberndorf, Austria, the small village and church where the Christmas carol "Silent Night" was performed for the first time on December 25, 1818.

LAW SUIT
After just a week of availability, Apple's iPhone 4 is the subject of a class-action lawsuit.
••• Citing the iPhone 4's antenna problems, which requires users to hold the smart phone in a particular way to avoid connection problems, law office Mason LLP has filed the suit in the U.S. District Court for the Northern District of California. It claims to be speaking on behalf of "hundreds of thousands" of iPhone 4 owners.
••• The focus of the lawsuit is to highlight what the plaintiffs say is a defective antenna. They are requesting that the court require Apple to offer a case at no charge to iPhone 4 buyers. The suit also asks for monetary damages related to the alleged "diminished value of the phone."

•• The case involves a dispute over how much Yahoo Inc. and RealNetworks Inc. should have to pay the American Society of Composers, Authors and Publishers in royalties for the ability to stream music on their websites.

••• The LA-Times reported that "the -- Federal court ruling made in, (September 28, 2010) -- has the potential to affect many websites that stream music, a federal appeals court on Tuesday threw out a lower court's method for determining music royalties, saying the calculations were flawed."
••• Though the case directly concerns Yahoo and RealNetworks, its outcome could affect how much numerous sites and online services -- including AOL, YouTube, Pandora, Slacker Radio and MOG -- pay for the right to stream music, said Jon Potter, a principal at RPG Strategies, a digital media consulting firm in Bethesda, Md.
••• "This will absolutely impact the royalty rates for all Internet radio companies and music streaming companies, as well as companies streaming any type of media with a musical component, including videos and games," Potter said.
••• At issue is a district court's decision in 2008 to set a 2.5% royalty rate for millions of songs owned by the 390,000 songwriters represented by ASCAP. RealNetworks and, in particular, Yahoo argued that the calculation was excessive.
••• A three-judge panel of the U.S. Court of Appeals for the 2nd Circuit sided with Yahoo, concluding that the lower court's method for setting royalties was "unreasonable" and "imprecise" because it overstated how much the sites benefited from having streaming music in various areas of the sites, the judges wrote in the ruling.
••• The appeals court faulted the lower court's "inclination to lump all of Yahoo's varying musical uses together, instead of looking into the nature and scope of Yahoo's different types of uses." On-demand music streaming, the court noted as an example, would have a revenue stream different from that of music that plays in the background of a video.
••• The ruling directed the lower court to come up with a new and fairer method for determining royalty payments.
••• Though Yahoo exited the music streaming business in 2008 when it handed that function of its site to CBS Radio, the case involves tens of millions of dollars in potential back royalty payments from Yahoo, Potter said. Overall, ASCAP stands to collect hundreds of millions of dollars more, depending on the outcome on the case.
••• Yahoo, in a statement, said it was "pleased with the court's decision and looks forward to the establishment of a truly reasonable royalty license rate that properly accounts for music use on its services."
••• RealNetworks shared Yahoo's sentiment, saying in a statement, "We believe the guidelines set forth in this decision will help establish more fair and reasonable royalty rates for Internet music providers."

••• Mattel Inc. was accused by rival MGA Entertainment Inc. of spying on rival toy companies for at least 15 years, (since 1995) -- and defrauding it out of secret details on more than 50 products, in an escalation of the battle over the popular Bratz dolls.
••• MGA said the maker of Barbie and Ken dolls went so far as to print up fake business cards at Kinko's to help it gain entry and obtain a "holy grail" of information about rivals.
••• Reuters reported that it was Mattel who generated, and distributed secret Bratz doll information . . . from the Barbie Doll company forays since 1995, were widely distributed within the company and reviewed by Mattel's Chief Executive Robert A. Eckert, the filing said.

As U.S. District Judge Louis L. Stanton in New York explained, Congress recognized that the Internet couldn't function if broadband providers, search engines and hosting services were held liable for every unauthorized copy made on their networks. The Digital Millennium Copyright Act of 1998 protected those companies from liability as long as they acted quickly to remove any infringing material identified by copyright holders.
••• Viacom argued that YouTube didn't qualify for this protection because infringements were common and central to the company's fortunes. Echoing earlier rulings, however, Judge Stanton held that the law doesn't require YouTube to police its network for bootlegged videos. Instead, it only has to remove the items singled out by copyright holders. That's sensible -- copyright owners are far better positioned to know whether a clip was used legally or not. In fact, many of the clips cited in the original lawsuit weren't infringing. At least 100 had been posted by marketers employed by Viacom.
••• Google Inc.'s YouTube didn't violate Viacom Inc. copyrights when content including clips from its MTV and Comedy Central cable television channels were posted on the video-sharing website, the judge ruled.
••• Judge Stanton in New York said YouTube wasn't liable for infringement. Viacom, controlled by Sumner Redstone, had sought at least $1 billion in damages, according to a revised complaint filed in April 2008.
••• Stanton agreed with YouTube that it was protected by the safe-harbor provision of the federal Digital Millennium Copyright Act, which says a service provider isn't liable for infringement if it removes material from its site when notified by the copyright owner.
••• "The provider must know of the particular case before he can control it," Stanton said in the ruling. "The provider need not monitor or seek out facts indicating such activity."
••• More than 24 hours worth of video is uploaded to the YouTube site every minute, the judge said. YouTube had a policy of removing infringing content from its site and banning users after three such offenses, according to the ruling.
•• In the past Hollywood Entertainment producers, and their Associations have asked the courts repeatedly for help in coping with online piracy, but the results have been decidedly mixed.
•• Although judges have come down hard on numerous file-sharing networks and search engines that specialize in bootlegs, they've ruled in favor of several websites whose content is generated by users, even if it wasn't authorized by the copyright holders.
•• The latest may be the most significant: Judge Stanton dismissed Viacom allegations that Google's YouTube had built its business by turning a blind eye to widespread copyright infringements.
•• Both companies asked Judge Stanton in March to decide the case in their favor without a trial. Viacom said YouTube benefited financially by allowing users to post and share programs including "The Daily Show With Jon Stewart" and "South Park" on its website without authorization. The ruling, which Viacom plans to appeal, reaffirmed the crucial principle that online companies should be held responsible for what they do, not what others do with their services. ••• The LA Times reported that some analysts assert that the ruling increases the burden on entertainment companies, but it really just rebuffs another effort to shift copyright holders' responsibilities onto the middlemen who have opened new distribution pathways online.

•• Many entertainment companies have come to accept that reality, striking deals with YouTube and others to generate revenue from the material that fans post online.
•• Meanwhile, YouTube and its competitors are adding filtering technologies that enable this monetization, as well as giving copyright holders more say over what gets posted. •• • Time Warner Cable Inc. and other distributors have asked the FCC to revisit the retransmission consent rules, and the agency is soliciting comments on the topic.

•• • Although Genachowski tried to assuage fears that the FCC would force broadcasters to cough up spectrum, he said the situation could become dire.
•• • "We're at serious risk as a country in not moving quickly enough on our technology infrastructure and in other areas to remain the world's leader in innovation."
•• • This is not "theory or idle speculation," he added. "It's math and physics."
•• • Spectrum wasn't the only issue of concern that Genachowski broached. He also talked about recent fights between cable operators and broadcasters over fees that in some cases have led to cable customers losing access to local TV channels. •• • Two of those companies &emdash; InkPlusToner.com of Canoga Park, Calif., and Comptree Inc. of City of Industry, Calif., have agreed to stop the imports and paid HP an undisclosed sum. HP expects to reach a similar agreement with Smartone Services LLC of Hayward, Calif.
•• • Zhuhai Gree Magneto-Electric Co. of China has asked an administrative law judge to end the commission's investigation after agreeing to cease importing these ink cartridges.
•• • A default judgment was entered against the remaining seven companies: Mipo International Ltd. of Hong Kong, Mextec Group Inc. of Miami, Fla., and five Chinese companies, Shanghai Angel Printer Supplies Co. ••• May 7, 2010 / California homeowners will be required to install carbon monoxide detectors starting in July 2011 under a bill signed Friday by Gov. Arnold Schwarzenegger that is aimed at preventing deaths and injuries caused by poisoning from the odorless, colorless gas.
•••Up to 40 California residents die each year from carbon monoxide poisoning, according to state Sen. Alan Lowenthal (D-Long Beach), whose legislation was signed by the governor.
••• "SB 183 will help put an end to the senseless deaths and injuries Californians suffer due to accidental carbon monoxide poisoning every year," said Kevin Nida, president of the California State Firefighters' Assn.
••• The California Air Resources Board says an average of 30 to 40 "avoidable deaths" occur in California each year because of unintentional carbon monoxide poisoning. Lowenthal said there also are hundreds of "avoidable" emergency room visits and hospitalizations in the state each year.
••• The bill requires that alarm devices, which can cost less than $30, to be installed in existing single-family homes that have a fossil-fuel burning appliance, fireplace or attached garage, starting in mid-2011. All other residential units will have to have the detectors in place by Jan. 1, 2013.

•• • The shareholders sued Kerkorian and his Tracinda investment company in 2003. They alleged that James Aljian, who helped manage Tracinda's investments and served on DaimlerChrysler's shareholder committee board, passed confidential information about the company's declining cash flow to Kerkorian in 1999.
•• • Tracinda then sold 7.6 million shares over a three-month period, avoiding $120 million in losses at the expense of other shareholders, according to the complaint.
•• • Aljian, who was also named as a defendant in the case, died in 2007. As part of the settlement, the shareholders agreed to dismiss Kerkorian from the case, leaving Tracinda as the lone remaining defendant.
•• • John Kehoe, a lawyer for the shareholders, declined to comment on the proposed settlement. Patricia Glaser, a lawyer for Kerkorian and Tracinda, didn't immediately comment.

••• Fujitsu was approved for a trademark on the iPad name for use in hand-held computing devices. The name was assigned to Apple by Fujitsu, records made public Friday show.
••• Owning the trademark on the iPad name allows Apple to forbid others from using it without its permission and eliminates the possbility of a legal battle over the name between Apple ana Fujitsu, which first sought the ttrademar in 2003.
••• Bloomberg reported that it was time to "Tip your hat to Apple today as it has succeeded at obtaining full rights to the iPad trademark from Fujitsu. The trademark was previously owned by Fujitsu who developed and sold a handheld scanner with the name 'iPad" in 2002; the mobile device was used by retailers to track inventory, check prices, and complete sales away from a stationary sales terminal. Fujitsu applied for the "iPad" trademark in 2003 and it remained in limbo until April 2009 when it fell into "abandoned" status. Fujitsu re-opened the trademark application and the USPTO published it for public review and comment in September 2009. This newly re-opened trademark caught Apple's attention and the Cupertino company went on the offensive by objecting to Fujitsu's application and filing its own trademark application for the term iPad."
••• Over the course of the past few months, Apple and Fujitsu have waged a minor shouting war over the trademark with Fujitsu claiming ownership and Apple objecting. With the Apple iPad slated to launch on April 3rd, solving the issue surrounding the iPad name  became imperative for Apple. Though the details are unknown, Apple and Fujitsu have worked out a last minute agreement as a document uncovered by PatentAuthority.com reveals that Fujitsu re-assigned the iPad trademark in its entirety to Apple. The transfer was completed and the trademark was assigned to Apple on March 17th, approximately two weeks before the April 3rd launch date.
••• What transpired must have happened behind tightly closed doors as nary a word of this agreement has been made public until now. Though we don't know with certainty, we can only presume that it involved the transfer of a large lump sum of cash from Apple to Fujitsu in return for the rights to the name iPad. •106 Hewlett Packard Co. settles China ServiceMark infringement suit. HP, reported on • March 18, 2010 -- that it had reached settlements with three companies that have been accused of infringing on the printer company's patents for ink cartridges.
•• • HP filed a complaint with the U.S. International Trade Commission in September, seeking to ban imports of ink cartridges by 11 companies.
•• • Two of those companies &emdash; InkPlusToner.com of Canoga Park, Calif., and Comptree Inc. of City of Industry, Calif., have agreed to stop the imports and paid HP an undisclosed sum. HP expects to reach a similar agreement with Smartone Services LLC of Hayward, Calif.

The end of the 1970s found Troy Cory playing Santa Claus in the German/American production film "Merry Christmas: Just in the Nick of Time," starring Priscilla Cory, as "Little Miss Santa," and featuring the late German singer, Manuela. Produced by VRA TelePlay Pictures, Bohemia Film and Gábor Wagner, of ARD, the story was filmed in and around the city of Munich, Nymphenburg and Castle Neuschwanstein, Germany and in Oberndorf, Austria, the small village and church where the Christmas carol "Silent Night" was performed for the first time on December 25, 1818.

"The word is used when a personal name is giving to personal services," -- (like Charlie Rose Show, The Troy Cory Show, and the initials NBS, the acronyms for the elements and effects of Nathan B. Stubblefield's WiTEL®™©).
••• The PowerMat and Row22 are eponymos. They are just two items named after existing products. I found them most interesting, becausehe PowerMat was a take off on Stubblefields, "All Green Earth Battery" (a non - fossil fuel technology) patented in 1898.
••• The only thing missing was the iron rod RF aerial, that made the WiFi induction unit part his "Telephone-del-Green" system. •• • The justices rejected an appeal Monday from Cablevision Systems Corp. The court upheld a federal "must carry" law, enacted in 1992 when cable TV systems faced much less competition than they do today.
•• • Cablevision, the nation's fifth-largest cable TV operator, sued the Federal Communications Commission over its ruling that forced Cablevision to carry the signal of a distant home-shopping station on its Long Island cable systems. The federal appeals court in New York upheld the FCC's determination.
•• • Cablevision said in court papers that "the monopolistic nature of the cable industry...has been replaced by vibrant competition."

MAY 22, 2010 / Google Inc.'s $750 million acquisition of mobile ad service AdMob cleared its final hurdle Friday with a boost from AdMob's jilted suitor, Apple Inc.
•• • The Federal Trade Commission said it unanimously decided to approve Google's AdMob deal mainly because of Apple's recent push into the $600 million mobile advertising market in the U.S. The ruling closes a six-month antitrust investigation.
•• • The emergence of another deep-pocketed competitor eased the FTC's concerns that Google would be able to use AdMob as a springboard for extending its dominance into the nascent field of wireless devices.

•• • Starting June 1, smart-phone buyers will havae to pay $325 for breaking their contracts, up from $175 currently. For buyers of regular phones, the fee is being decreased by $25 to $150.

••• Since that time I've written a lot of memos and direct story about the transparent fraudulent activities created by those certain rule makers over the years in preparation for the collection of moneies now all due and payable by Telco organizations. To prevent Lawsuits, and any misunderstanding between existing Telcos, the Library of Congress, the USPTO, FTC, and FCC, the new series of TVInew aticles, "CloseUps," and Take2, was prepared at the request of the WTQCA association. That's something that never would have happened before the Monetary
Crash of 2008.

••• The game of poker is truly a game of skill and in todays society, thanks to television coverage and all those celebrities indulging in the game, it is a household word.
••• Legend has it, that poker dates back to 900 BC in China when Mu-Tsung was said to have played a form of '' domino cards''.   It has also been said that poker evovled in the 1400's as a European game.  However, Poker in America started in Mississippi on riverboats and was a compliment to three card Monti , which was dealt with a 20 card deck that only contained aces, kings, queens, jacks and10's.
••• The big step in the evolution of poker was in Neveda where it was declared illegal in 1910.  In California the Attorney General declared it a game of skill, thus anti-gambling laws couldn't stop the masses from playing poker.  Then, in 1931 poker was declared a legal game in Nevada.
••• What's not to like with a chef from Italy, a diversed staff, and an all new State-of-the-Art Grand Poker Ballroom.  It's an impressive and exciting place to visit.  A place where younever know who's playing poker or for that matter Pai Chi.
••• I came across some actors I interviewed over the years, and one of them was Glen Thurman.  Glen  is not only a fine actor but he is an excelent poker palyer, who enjoys to play at The Bicycle Casino. This event celebrated the 25th anniversary of The Bicycle Casino and the opening of their Grand Poker Ballroom.

The LAtimes reported that . . . in deciding that China broke international trade rules by restricting imports of movies, music and books, the World Trade Organization handed the U.S. a victory in a contentious issue that has long rankled purveyors of copyrighted media products.

But it doesn't mean Hollywood or Silicon Valley will be cashing in any time soon.

The ruling, issued Wednesday by a WTO panel in Geneva, called on China to stop requiring foreign media suppliers to go through the costly process of distributing goods through Chinese state-owned entities. It also urged China to allow foreign companies to sell music over the Internet, a potentially huge opportunity for companies such as Apple Inc., with its iTunes. China has the largest number of Internet users, but piracy online and in the streets is rampant.
The decision was seen as one of the toughest against China by the WTO since it joined the trade body in 2001 and agreed to give equal treatment for domestic and foreign companies. And it comes as the U.S. continues to face a massive trade deficit with China -- $103 billion through June of this year -- an issue that the Obama administration has yet to tackle head on but which looms large in the coming months.

Although China has complied with past WTO rulings against it, analysts say Beijing could appeal the latest decision, which could drag out the case for many more months. The complaint was first brought by the U.S. in spring 2007. MORE COMING.

Army Archerd interviewed everyone from Hollywood stars to heads of state in his illustrious 52 years as a Daily Variety columnist.
In 1947, Archerd was hired by the Herald-Express as assistant (i.e., "leg man") to drama-movie editor-columnist Harrison Carroll.
In addition to covering the studios, Archerd began reporting on the local nightclub scene, which included Sunset Strip sites like the Mocambo and Ciro's and music spots down La Cienega, La Brea and Ventura Boulevard.

• FCC reclassification proposal would not give the FCC power to control prices or demand line-sharing.
••••Rate regulation and line sharing are off the table," FCC Chairman Julius Genachowski said, during the recent Cable Show in Los Angeles, where he defended to a skeptical audience the FCC's recent decision to partially reclassify broadband providers as common carriers under section two of the Communications Act. The FCC chief pledged to retain a light touch over broadband regulation, after a court ruling last month threw into doubt the agency's authority.
•••• The top U.S. communications regulator said, "government and broadband providers can find a solution to overcome industry fears of potential heavy regulation of the Internet."
•••• There's still a lot of detail to be hashed out here, and the proposal must be opened to public comment and then receive approval from at least three of the five FCC Commissioners. Genachowski appears to be trying to please everybody -- which may or may not work.
•••• Again, the debate is open to policy makers for years to come -- but it appears that the FCC is trying to find some kind of middle ground between carriers, who of course would love an FCC that had no authority of any kind and consumer advocates (who want a tough regulator on the go crafting new regulations).
•••• The key is to drive greater broadband adoption. "Getting people to adopt broadband is as near win-win for the government and the industry as I've ever seen," Genachowski said.
•••• He insisted that his proposal explicitly would not give the FCC power to control prices or demand line-sharing.
Rate regulation and line sharing are off the table," Genachowski said.
•••• The problem is that the recent court case Comcast brought against the FCC and decided in favor of Comcast damaged the legal foundation supporting everything the FCC would like to do to promote broadband adoption, which Genachowski said the FCC has been articulating clearly all along.
•••• The Comcast decision, he said, doesn't change the FCC's aims or policy goals at all. The question, he said, "is how do we get back to a solid legal foundation to do what we want to do &endash; and not more. We reject both extremes. One extreme is to do nothing. The other is to implement all of Title II" &endash; the provisions in telecommunications law that give the FCC very broad and intrusive control over telephony.
•••• He said that the "third way" approach is to pare down Title II to only those provisions that allow the FCC to encourage broadband adoption. "Our staff has developed a narrow approach with barriers against regulatory creep, and regulatory over-reaching, and gets us to a legal foundation similar to where we were before the Comcast decision." ••• The festival headquarters will be at the historic Mann's Chinese Theaters between October 30th and November 5th, and then move to the seaside for screening in Santa Monica presented in association with the American Film Market (AFM). The Hollywood Roosevelt returns as the festival's host hotel.
