"Happy Birthday to You" ruled public
domain
A federal court judge in Los Angeles has
declared the song Happy Birthday to You
belongs in the public domain, dealing a
blow to the music publishing company that
for decades has been collecting royalties
from the songs.
US district judge George H King ruled on
Tuesday the copyright originally filed by
the Clayton F Summy Co in 1935 applied to
a specific arrangement of the song, not
the tune itself.
King ruled that Summy never acquired the
rights to the song's lyrics, and the
defendants' claims to the contrary were
"implausible and unreasonable."
"Because Summy Co never acquired the
rights to the Happy Birthday
lyrics,[the] defendants, as Summy
Co's purported successors-in-interest, do
not own a valid copyright in the Happy
Birthday lyrics," King wrote in a judgment
posted online.
"Happy Birthday is finally free after 80
years," said Randall Newman, an attorney
for the plaintiffs. "Finally, the charade
is over. It's unbelievable."
Up until now, Warner Chappell Music, a
division of the Warner Music Group, has
charged people for use of the song.
Among the plaintiffs was film-maker
Jennifer Nelson, who was told she would
have to pay $1,500 USD in order to include
Happy Birthday in a documentary she was
making about its history.
Warner Chappell Music has been enforcing
the copyright claim since it bought
Summy's successor, Birchtree Ltd, in 1988.
It reportedly paid $25m for the
company.
Jay Morgenstern, then executive vice
president of the Warner Chappell Music
Group, told the New York Times a year
after the acquisition the song had proved
"a very good investment".
Happy Birthday was written by sisters
Parry and Mildred Hill of Kentucky in
1883, and is often claimed to be the
world's most popular song.
Without the court judgement, it would not
have been freely available in the public
domain in the US until 2030, and in the EU
until 31 December 2016.

passed away August 3, 2015, in
Mühldorf, Germany, at the age of
80.
He
shared the stage with Ella Fitzgerald,
Louis Armstrong , Count Basie and Chubby
Checker.
Speaking
with his wife Margit this morning, Ambros
died Monday evening after his health
deteriorated in the last few month. She
said, "he had a 'full life,' and a big
heart."
Since
the fall during a performance on the dream
ship MS Deutschland, in 2011, when he
broke his arm multiple times, he was no
longer able to play an instrument which
for him meant the end of a long successful
career.
"My
first recordings in Germany were arranged
and conducted by my good friend Ambros,"
and arranger Sylvester Levay," says Troy.
He has been a great help and I always had
the utmost respect for him." He was the
ultimate musician. We are truly saddened
by the news of his passing, but he will
never be forgotten and will always have a
place in our heart.
He
leaves behind
his wife Margit and sons Dominique (from
his 1st marriage) Ambros und Max, who is
following in his father's footsteps.

Tell"
Tell me your
problems and I'll tell you mine, is the
old approach to get some people to open up
and extract information.
Facebook is the world's most popular
social network. It is the company's 'Kiss
& Tell' mission to be the ultimate
placer for everybody to share just about
everything. Most people populate their
their feeds with only the most flattering
posts, like vacation and family photos,
promotional work and other not so humble
brags.
As in a recent very personal post by the
Zuckerbergs, the social network encourages
others to share their struggles, to better
reflect reality, saying "in today's open
and connected world discussing these
issues doesn't distance us: it bring us
together. It creates understanding and
tolerance;" and also more motivated 'kiss
& tell' users.
Sharing the most personal Facebook urges
users to share just about everything about
heir lives. There are however people that
do not hew that philosophy and the
tendency to expose their personal
challenges. That leaves open the question
still what is and is not appropriate to
share on social medias.

An international
hacking ring armed with tens of
thousands of corporate secrets pocketed
more than $100 million from
illicit trades, targeting a core
vulnerability of the financial system
in one of the digital age's most
sprawling insider-trading schemes
according to federal
investigators.
The indictment
filed in US District Court accused foreign
based hacking network of downloading more
than 150,000 press releases for traders in
the U.S. and elsewhere. The traders paid
the hackers a flat rate or percentage of
the profit.

Top Hollywood Studios face EU antitrust
probe
The EU accused six top Hollywood
studios and the Sky TV pay channel of
breaching antitrust laws, in the latest
salvo in Brussels' efforts to break down
digital barriers in Europe.
Brussels accuses Disney, NBCUniversal,
Paramount Pictures, Sony, Twentieth
Century Fox and Warner Bros, as well as
Britain and Ireland's Sky TV of using
movie licenses to block access to their
content in other European Union countries.
The charges are the newest in a series
made by the EU's new Competition
